Even if you are in the Backseat, you can still be Charged with a DUI

Bedford County backseat driver charged with DUI

DUI Attorney Leslee Tingle comments on the charge:

“In Virginia, even if you’re in the backseat, you are capable of being charged with a DWI!  Recently, a young woman was charged in Bedford with a DWI because she drunkenly grabbed the steering wheel from the backseat causing the car to flip.  All five riders were hospitalized.  However strange this might be to read, this behavior does constitute operation of a motor vehicle.  Word to the wise, don’t drive drunk, and if you’re the designated driver, make sure your passengers are calm and following your directions not to interfere with car operations!”

Virginia Speed Traps Exposed

What is a Speed Trap?

When most people think about speed traps, they think about police hiding behind billboards or waiting to pick off motorists right where the speed limit changes.

However, there is a broader, more accurate definition that covers these situations and more:

A speed trap exists wherever traffic enforcement is focused on extracting revenue from drivers instead of improving safety, made possible by speed limits posted below the prevailing flow of traffic.

As a courtesy to all drivers, our firm will be posting information on existing speed traps in the jurisdictions in which we practice weekly. Check recent posts for county and city specific speed traps.

All information was obtained by the National Motorists Association

Does Selling Wine in Grocery Stores Increase the Risk of Underage Drinking?

Wine-in-grocery-stores debate: claims vs. facts

Tennessee is having the most important debate for wine lovers…will they allow wine to be sold in grocery stores???  Luckily, Virginia doesn’t have this problem.  We sell wine and beer in the grocery store and leave the hard liquor for the ABC store.  It’s easy to understand the arguments both for and against this issue…and of course, change is always hard.  However, wine is becoming a cultural phenomenon around the country.  America’s wine industry is booming, and the convenience of picking up a bottle of wine with dinner is something Virginians certainly wouldn’t be able to live without.

However, “Convenience and grocery stores aren’t as diligent in checking identification, so selling wine there will increase underage drinking.” This seems to be the thought process of a Nashville psychiatrist who specializes in addiction. Madison County Sheriff David Woolfork has been outspoken against bringing wine sales to food stores. Woolfork said his officers have seen firsthand the impact alcohol can have on underage drinkers. He believes the measure would worsen the problem. “The fact that you have more convenience stores selling more wine,” he said, “the more underage are going to be drinking.” Woolfork worries that convenience store clerks aren’t as diligent in checking IDs as other alcohol sellers. “Convenience stores have such a tremendous turnover,” he said. “Two words come to my mind, and that’s convenience versus public safety.”

Police Officer Charged with Reckless Driving!

Waynesboro Police Officer Charged with Reckless Driving

Virginia Reckless Driving Attorney Leslee Tingle of Miller Cerasuolo, PLLC comments on the charge:

“An on-duty police officer in Waynesboro, VA has been charged with reckless driving.  Officer Shamica Spears was in route to a domestic violence call when she t-boned another vehicle at an intersection.  The officer had her emergency lights on, but after investigation, the police department concluded that she did not move through the intersection in a cautious manner.  Officer Spears is facing criminal misdemeanor charges, with the possibility of a fine up to $2,500 and a year in jail.  No one was seriously injured in the crash, so it is unlikely that she will face the maximum penalty for the charge.  In fact, this charge may even be reduced to an improper driving conviction.  Regardless of the outcome, I’m sure that she will be facing additional job related consequences.”

WWE Star ARRESTED for DUI and Marijuana

WWE STAR JACK SWAGGER ARRESTED for DUI & Pot

Virginia DUI Attorney Leslee Tingle comments on the arrest:

“WWE fighter, Jack Swagger, was arrested for driving under the influence and having marijuana in his car.  …and you have to see this guy’s mug shot!  If he didn’t think he looked high and drunk, he should take a sober look at this picture! In Virginia, whether or not he would be facing mandatory jail time would be dependent on his level of intoxication and how many times he has previously been convicted of these offenses.”

Your smartphone just got a little smarter… and more convenient. Possibly allowing you to avoid traffic delays and police officers.

Trapster is an application that you can download to your phone and it will notify you of police speed traps and other road hazards. Even though it is a fairly new app on the market, it already has 16 million users world-wide and reportedly adds about 8,000 users a day. With over 5 MILLION traps reported world-wide, each user is given instant access to the world’s most accurate and up-to-date road conditions resource.

How does it work?

Users of the app submit cops in the area, speed traps, enforcement cameras, and road hazards. Trapster then alerts all of its users in the area. It is like a high-tech version of flashing your headlights to alert drivers of potential road hazards. To report hazards or traps, users click a Report Trap button, and then drag the appropriate icon to the correct location. Easy as pie.
