“Musician and actor Rick Springfield was recently arrested because of a bench warrant which was issued because he failed to appear in court.  Springfield was to appear in court with evidence that he had completed an alcohol education program which was a requirement for a plea agreement from a previous DUI arrest.  When this situation occurs in Virginia, the Judge will often either issue a capias or a show cause.  However, often an attorney can have these later dismissed depending on the circumstances.  It is also worth noting that Springfield threatened to kill the deputy and his family if he had his car towed.  This sort of behavior can have an extremely detrimental impact, often making it more difficult to have a favorable resolution of the case.”

“There has been a large outcry recently over the use of speed cameras throughout the country.  The problem has primarily revolved around due process concerns.  Many times these tickets do not involve a scheduled court date in order to try to defend against the offense you are charged with.  Instead, the state will typically just send a bill for the fine.  Some systems, such as this one in Elmwood Place, Ohio, allow for a hearing but require an additional $25 fee.  Luckily, there has yet to be any speed camera systems installed in Virginia.”

DUI Checkpoints This Weekend for St. Patrick’s Day

CBS 6 recently reported: “Police plan to be out in full force over the St. Patrick’s Day weekend looking for drunk drivers. The exact locations for their DUI checkpoints are not being disclosed.

Police encourage drivers to have a plan in place that includes having a designated driver.  They also want drivers to call 911 if they see another driver they suspect might be driving drunk.

Henrico County Commonwealth’s Attorney Shannon Taylor said fighting drunk driving is a community-wide effort.

“It’s a team effort, because obviously more people sending out the message is more times the message is being heard,” Taylor said.  “And what we hope is that people are safe.  Again it’s about public safety not just to the person involved but to the people they could potentially injure.”

From 2006 to 2010 more than 700 people nationwide were killed in drunk driving crashes during the St. Patrick Day holiday.

Chesterfield County plans to begin implementing DUI checkpoints as early as this evening.”

“Three people died in Petersburg, Virginia last month because of a single vehicle crash.  Reports indicate that at least one person was ejected from the car.  This type of injury seems common when people aren’t wearing their seatbelts.  In Virginia, the law requires that drivers and adult passengers in the front seat wear their seatbelt.  If a police officer pulls you over for another infraction, he has the right to write you a ticket for not wearing your seat belt.  Although the fine is low and pre-payable, it is an offense that will probably show up on your driving record.  Most states, including Virginia, don’t give points for this offense.  However, you should be aware that your insurance premiums may increase if you get this ticket.  If you get injured in a car accident, your insurance company may be on the hook for your medical expenses…so you can bet that if they see this kind of charge on your record, they will think you are more of a risk.”

Traffic Tickets are a Multi-Billion Industry

The National Motorists Association recently posted an article on the truth about Virginia traffic tickets: “Tickets have virtually nothing to do with highway safety, but they have everything to do with money.

When you begin to grasp the full magnitude of the public and private interests that depend on ripping off motorists through traffic tickets, you begin to understand why this unethical system continues to expand every year.

No one knows how many traffic tickets are actually issued. Many local units of government deliberately hide this information so they don’t have to split their traffic ticket revenue with the state. Not including parking tickets, we can estimate that somewhere between 25 and 50 million traffic tickets are issued each year. Assuming an average ticket cost of $150.00, the total up front profit from tickets ranges from 3.75 to 7.5 billion dollars.

If just half of these tickets result in insurance surcharges (typically at least $300 over a period of three years), you can add another 3.75 to 7.5 billion dollars in profit for insurance companies. This is why insurance companies “care” so much traffic “safety” programs and are willing to donate millions of dollars worth of radar and laser guns to the police. For them, it’s simple: more tickets equal more money!

Realistically, there is no connection between receiving an occasional traffic ticket and the likelihood of being in an accident. So, there is no justification for charging a person more for auto insurance because they were convicted for a random traffic violation. The purpose of insurance is to cover unusual risk. The act of exceeding an unreasonably low limit is hardly an “unusual risk.” That means speeding ticket surcharges are pure profit for the insurance industry.

In total, we’re talking about 7.5 to 15 billion dollars annually from tickets for government agencies and insurance companies. That’s more money than several states take in from all taxes! Worse still, that total doesn’t even include the money that “traffic schools,” radar-detector manufacturers, and scanner producers make.

The police enforce laws that result in direct benefits to police agencies and personnel. Judges hear cases in which a “guilty” verdict would have tangible financially rewards for the court and courthouse personnel. No other class of “crime” is as profitable for state and local governments as is that of traffic tickets. Traffic courts cannot be fair and unbiased when their financial welfare depends on traffic fines. Additionally, local government encourage traffic enforcement practices that rip off travelers to support local government services and to reward government employees. Yet these hypocrisies go largely unnoticed.

Until changes are made, you should forget the general notion that traffic tickets are fair and traffic courts are just. The entire system focuses on maximizing income. That’s why most of the people who seriously contest a traffic ticket either win or are offered an good plea bargain. They don’t want anyone “making waves“, that would cost them money. That’s yet another good reason why you should fight your traffic ticket!”
